Immoral Trafficking

Trafficking is a word which is most prominently used as synonymous to prostitution. Prostitution is a shame to the human civilisation. Prostitution and the related evil of trafficking in persons for this purpose are against the very concept of human dignity and are incompatible to human person and social values thereby endanger the welfare of the individual, the family and the community. It has rightly been expressed by the Supreme Court as :

"Prostitution always remains as a running sore in the body of civilisation and destroys all moral values. The causes and evil effects of prostitution maligning the society are son notorious and frightful that none can gainsay it. This malignity is daily and hourly threatening the community at large slowly but steadily making its way onwards leaving track marked with broken hopes. Therefore, the necessity for appropriate and drastic action to eradicate this evil has become apparent".

Prostitution and the Indian Penal Code

Indian Penal Code enacted in 1860 in the main penal law in India which strikes at the prostitution and provides for punishment for such acts. Section 372 of the code prohibits selling minors for the purpose of prostitution etc. where as Section 373 prohibits buying of minors for the purpose of prostitution etc. Here for our purpose minor includes minor girls and in such cases girls are prominently bought or sold to be engaged in this illegal act.

Section 372 says that "whoever sells, lets to hire or otherwise disposes of any person under the age of eighteen years with intent that such person shall at any age be employed or used for the purpose of prostitution or illicit intercourse with any person or for any unlawful and immoral purpose, or knowing it to be likely that such person will at any age be employed or used for any such purpose, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine".

Section 373 of the code provides that "whoever hires or otherwise obtains possession of any person under the age or eighteen years with intent that such person shall at any age be employed or used for the purpose of prostitution or illicit intercourse with any person or for any unlawful or immoral purpose, or knowing it to be likely that such person will at any age be employed or used for any such purpose, shall be punished with imprisonment or either description for a term which may extend to ten years, and shall also be liable to fine".

The Immoral Trafficking Prevention Act, 1956

PREVENTIVE MEASURES :

1. Police Circular Order 343/2013 regarding Standard Operating Procedure (SOP) for investigation of Crime against women has been issued to all the District SsP/ DCsP, Bhubaneswar-Cuttack/ SRP Rourkela and SRP, Cuttack vide No. 27143/SR "W" dated 30.06.2013.

2. Police Circular Order 338/2013 regarding Prompt investigation and prosecution of crime against women has been issued to all the District SsP./ DCsP, Bhubaneswar-Cuttack / SRP Rourkela and SRP, Cuttack vide No.27224/SR"W" dated 30.05.2013 in which order have been passed that all offences against women shall be promptly investigated and as per as possible charge sheets filed in the court of law within sixty days.

3. Concerned Dist. Ss.P. /D.Cs.P. have been advised to intensify patrolling near shandies, women institutions, and during in fairs and festivals. They have also been asked to watch on activities of anti-socials/ drunkards and to conduct raids against circulation of obscene literature and display of blue films.

4. To facilitate integrated approach towards crime against women and children Mahila & Sishu Desks have been setup in 537 Police Stations of the State of Odisha in accordance with Police Order No.301/205 to deal with the complaints of victim women. The District HRPC will act as the Nodal Agencies in such matters within the District.

5. A toll Helpline Telephone Number 1091 has been connected to 6 Mahila Police Station of Odisha to attend the calls from the women victims for redressal of their problems.

6. Women and Child Cells have been setup under the control of Ss.P. of the district assisted by DSP,HRPC and comprising women Inspector & Women Officers & Men of the District to facilitate an integrated and improve response of the police to crime against women & children.

7. Women & child Protection PCR Van with necessary staff with the district police have been provided to women and child cell to attend to all urgent calls received from women and distress.

8. The Chief General Manager, Telecom, Odisha, Bhubaneswar has been moved for allotment of toll free women helpline telephone number to all district women and child cell to attend the calls from the victim women for 24 hours.
